A legal challenge against us sanctions
Early in August, Joseph Kabila filed a lawsuit with the American judiciary, aiming to have his designation removed from the blacklist maintained by the Office of Foreign Assets Control (OFAC), the United States Treasury Department body responsible for enforcing economic sanctions. In a sixteen-page complaint, his legal team disputes Washington’s decision, asserting that the accusations against him lack sufficient evidence.
Kabila refutes all accusations
US authorities allege that the former president offered financial and logistical assistance to the Alliance Fleuve Congo (AFC), a political and military coalition where the M23 constitutes its primary component. Furthermore, Washington accuses him of encouraging Congolese military personnel to desert and of residing in Goma, located in the eastern Democratic Republic of Congo (RDC), under the protection of the M23. Joseph Kabila explicitly denies these charges. His defense argues that the elements presented by the American administration are too “vague” and “arbitrary,” failing to concretely establish the alleged facts.
Defense demands concrete evidence
The former president’s lawyers specifically highlight that the American dossier does not identify any precise financial transfers to the AFC. They also claim that no specific Congolese military personnel are named as having been incited to desert by Joseph Kabila. His defense further points out that in 2013, during his presidency, the Congolese army played a crucial role in defeating the M23.
A judicial confrontation amidst eastern RDC crisis
Joseph Kabila, who governed the RDC from 2001 to 2019, is now petitioning the federal court in Washington to lift the sanctions and clear his name from the OFAC list. This legal action unfolds as the M23 and the Alliance Fleuve Congo remain central to the ongoing conflict in eastern RDC, where diplomatic initiatives continue in an effort to achieve a political and security resolution.
